Can you provide some insight into how personal injury law applies to diving accidents such as the recent tragedy?
What Happens After An Accident
Victims and their families need to be aware of the specific legal aspects of the contracts that were allegedly signed, including what compensation was required if passengers were injured, where the company was located, where the ship actually exploded and what instructions the company gave or did . Don’t follow.
It is understandable. I assume travelers read the disclaimers thoroughly before embarking on this type of adventure. But what about the rest of us who hastily sign the waiver. It’s like taking your kids to a trampoline park. Entrepreneurs have signed a waiver. I quickly go through them and then sign. I bet many other parents do the same. What should parents do in this situation to protect their rights and still get their children signed up quickly so they can play?
Unfortunately it is very complicated. Exceptions regularly submitted to us appear to eliminate all liability of the business owner for any cause, potential loss or consequence. In reality, the business owner must follow standard procedures to protect their customers. For example, in a trampoline park, injuries while jumping are common and the entrepreneur must protect himself against lawsuits from customers due to injuries caused by jumping on the trampoline. However, the company must follow standard practices when operating a trampoline park: inspecting the trampolines for normal wear and tear, inspecting the grounds to ensure they are in good condition, and ensuring employees are skilled and knowledgeable in their duties. The question often becomes what “standard operating procedures” are and whether the business owner has followed them
I understand that. Trampoline parks are fun, but also full of injury risks. As a parent, I know I am going to an institution. I am also grateful that the owner is willing to participate in such a risky venture so that my children can have fun. I understand why he would use a waiver that would remove all liability. But as you said, they still need to maintain good practices.
Do The Poor Suffer Disproportionately From Legal Problems?
Have you ever had an incident where bad habits caused damage? If so, I think our readers would like to hear about it.
Yes, I have often seen bad habits hurt. I think about the thought of my client being placed in a wheelchair without lowering the arms of the wheelchair. When he was admitted, he fell sideways from the chair and broke his left hip. To make matters worse, the person who did not follow proper procedure accused my client of falling out of his wheelchair. In another case, my client underwent treatment for prostate cancer under general anesthesia. As he was wheeled from the operating room to the recovery room, his nurse lowered one of his rails to take his vital signs. He was then called to another room and forgot to replace the bed rails. He slipped out of bed and fell on his head, causing a mild traumatic brain injury (TBI). He was also accused of falling to the ground. (See the design here?) Security systems are designed to keep us safe. They are not written to waste anyone’s time or disappoint anyone.
I think you have seen many confusing situations full of emotions. How do you balance the emotional side of personal injury while ensuring your clients receive legal treatment?
It is very difficult! It took years to separate work and private life. Luckily my wife is a stand-up comedian and my three children don’t take me too seriously. I trust my friends, family members and colleagues. I cannot emphasize enough that this career is a marathon, not a sprint. If you don’t take care of yourself, you won’t support the customers who depend on you. Unfortunately, lawyers are leading America toward suicide and substance abuse. I have good friends who have left the legal profession and a number of other friends who I can turn to when I need them.

I didn’t know that suicide and substance abuse were higher than average among lawyers. I’m going to look into the matter as it seems like it needs more attention. I’m sure it helps if you have a woman who can make you laugh. Having a good friend to lean on is invaluable, especially when you’re in the dark.
You said you treat your career like a marathon. What do you hope to achieve in your career by running the marathon?
Luckily I have good role models like Fred Orr, Elliot Levitus and Tommy Malone. All three attorneys have made significant contributions to the legal profession, being recognized for their expertise and helping their colleagues achieve their goals.
They seem like known good guys. Having a good role model/mentor in business can have a big impact on your career. I know this for myself. How would you recommend other lawyers find good counsel?

I think the best advice would be to ask questions, keep an open mind, and try to find lawyers you want to emulate and find meaning in their careers. I am fortunate to live in a city with a strong legal community and feel comfortable approaching attorneys I do not know.
