Nov 1, 1999 San Francisco attorney Christopher Dolan believes he’s a better advocate for his clients because he’s a cyclist. “That’s what sets me apart from other personal injury attorneys,” says Dolan, who owns two BMWs and a Honda motorcycle. “I understand from experience the power of a motorcycle accident or a product problem.”
In his first trial, Dolan took on a strong opponent. He chose to sue the California Department of Transportation on behalf of his injured passenger, Robert Martin. Martin knew of Dolan through a Bay Area cycling team. When the dust settled, the jury awarded his client $2.5 million.
Dolan believes the experience of riding a hog adds to the value of his representation, a testament to how unique motorcycle law is. On the one hand, there are plaintiffs’ lawyers who work hard to represent motorcyclists in personal injury and product liability cases, and on the other hand, there are lawyers who work to defend motorcycle manufacturers and civil society organizations in similar situations. The case began when Dolan’s client, Martin, was riding his motorcycle on Highway 1 near Bolin in Northern California when he hit an Acura sedan coming from an unmarked intersection. The October 1994 accident left Martin with a severed radial artery in his right arm and injuries to his back, neck and shoulder, Dolan said. After four operations, he has little use of his fingers and his upper arm is fused with a metal rod and 10 pins.

To avoid the risk of his client’s new image being cheapened, Dolan took the unusual step of suing to have the image deleted electronically. The judge ruled in favor of Dolan.
“He was an incredible, wild and crazy guy,” Dolan says. “I wanted the jury to focus on the facts of the case, not that image. The tires did not affect the way he was driving.”
The results are surprising, Dolan says. “The judges loved him. It could have been someone’s brother or son,” he added.

Winning the case against Caltrans put Dolan’s practice on the map, and three years later, his litigation practice continues to grow. He currently owns the Dolan Law Firm in San Francisco with seven attorneys. About 60 percent of his cases are motorcycle accident and product liability cases.
Dolan said he knew he wanted to represent motorcyclists since he was a law student at Georgetown.
